California’s Cannabis Catastrophe: A System Rigged with Contamination

The Department of Cannabis Control is issuing a mandatory recall of a single CUREpen vape product due to the presence of the pesticide chlorfenapyr. (Dept. of Cannabis Control)

California’s cannabis market is spiraling into chaos, with the recent recall of a pesticide-tainted vape highlighting a system fraught with incompetence and deceit. Despite knowing about dangerous chemicals in legal weed for months, state regulators dragged their feet, putting consumers at risk.

The tainted product, an “Orange Cookies” vape by West Coast Cure, was found to exceed safety limits for the insecticide chlorfenapyr. Yet, the Department of Cannabis Control (DCC) took seven months to act, only after intense scrutiny from a Los Angeles Times investigation. This vape was just one of many contaminated products, all supposedly “certified safe” by a lab whose license is now suspended. The recall came way too late—most products had already been sold out.

Systemic Failures and Regulatory Incompetence

Why did it take so long? The DCC’s pathetic excuse for a response raises serious questions. The recalled vape had additional dangerous chemicals like paclobutrazol, banned at any level, and trifloxystrobin, found at four times the safe limit. Despite Infinite Chemical Analysis reporting these in November, the DCC remained silent.

It’s a symbolic recall, a slap on the wrist for the industry giants while consumers continue to be at risk. Elliot Lewis of Catalyst Dispensaries saw his stores sell out of the recalled vape months ago. The public backlash left him flustered and questioning the entire regulatory process.

Corruption and Fraud in Cannabis Testing

The real scandal? Private labs manipulate test results to win business, putting consumer health at risk. Infinite and Anresco Labs filed lawsuits against 13 such labs for manipulating test results. These labs, pivotal in the state’s reliance on private testing, are accused of issuing fraudulent safety certificates.

Industry Impact and Consumer Trust

With these recalls, public trust in the legal cannabis market is plummeting. Sales of licensed products have been slipping since their peak in 2021. The credibility of California’s adult-use market is in peril. Consumers, convinced all products are tainted, are turning away from legal stores.

Even worse, state efforts to encourage legal cannabis purchases, like the $5 million “Real CA Cannabis” campaign, are failing. Vape sales have dropped significantly since the June 14 article by The Times, and the state’s cannabis control agency’s attempts to promote the legal market are falling flat.

Conclusion: A Call for Accountability

California’s cannabis industry is in dire need of a crackdown on fraudulent labs and stricter enforcement of safety regulations. The state must restore public confidence and ensure consumer safety. Until then, the market will remain tainted, both figuratively and literally.

  1. I’ve been following Elliot along the way for a few years now, after challenging him before the City Council in Patterson. I think efforts like his are crucial, and he’s inspired a lot of others to do the same or at the very least, initiate their own efforts. The Control board is not ideal, but I believe we’ve begun to orient ourselves in the right direction. We have to get this right, we have one of the biggest and deepest markets in the world here in CA. Good article!
