
ALBANY — Finally, New York is getting its act together. After dragging its feet for over three years since cannabis was legalized, the state Cannabis Control Board is expected to officially adopt rules that will let adults 21 and older grow their own marijuana plants at home. It’s about damn time.
Public Comment and Approval: The proposed regulations, which were preliminarily approved in February, went through a 60-day public comment period that started late March. Once these regulations hit the state register, they’ll be in full effect. Retail marijuana stores will also get the green light to sell starter plants to customers, setting the stage for a blossoming home cultivation scene.
Growing Timeline: But here’s the kicker: with these delays, people looking to grow their own weed this year are on a tight timeline. The rules allow up to six plants per person, with three mature and three immature. For those growing outdoors, the summer solstice on June 20th is generally the last chance to start your plants under the sun. So, if you’re in New York, you better get moving.
Regulations and Limits: The new rules stipulate that each residence can have no more than six mature and six immature plants, regardless of the number of adult residents. You can possess up to five pounds of cannabis flower from these plants, which translates to a decent stash for personal use. For those turning their flower into concentrates, the amount you can possess is based on the equivalent weight of the original plant material.
The Waiting Game: The Marijuana Regulation and Taxation Act, which approved home cultivation, stated this could only happen after the first legal retail sale. That didn’t take place until December 2022. Since then, the underground market has boomed, with unlicensed stores popping up and law enforcement struggling to keep up. It’s clear the demand for homegrown cannabis is high, and these new regulations are a crucial step towards meeting that demand.
Law Enforcement and the Black Market: Despite the delays, law enforcement has seen a significant drop in the number of marijuana plants seized. Many agencies have stopped their annual missions to find and destroy illegal crops, indicating a shift in priorities. Meanwhile, marijuana seeds, which have been legally sold in the U.S. since 2018 under the Agriculture Improvement Act, are readily available, adding to the underground market’s growth.
