
In a landmark shift, the Texas House of Representatives has taken a decisive step towards modifying the state’s stance on marijuana possession. The newly proposed House Bill 218 is set to alter the landscape of cannabis law enforcement, demonstrating Texas’s recognition of evolving perspectives on marijuana use.
House Bill 218 aims to redefine the legal repercussions for individuals found with up to one ounce of marijuana or cannabis concentrate. Under this bill, such possession would no longer warrant an arrest but would be classified as a Class C misdemeanor, potentially incurring a fine.
This progressive measure marks a significant departure from existing laws that deem possession of small amounts of marijuana a Class B misdemeanor, with much harsher penalties including jail time and hefty fines.
State Rep. Joe Moody, who spearheaded HB 218, elucidates the bill’s intent to smartly address personal cannabis use. “It remains illegal, but we’re addressing it in a smarter way than we do now,” affirms Moody, emphasizing the non-arrestable nature of the offense if the bill passes.
Following the House’s approval, the focus now shifts to the Texas Senate’s deliberation over HB 218. Previous attempts by Moody in the 2019 and 2021 legislative sessions saw House approval but ultimately did not secure Senate backing.
