As the 2024 elections approach, several states are poised to make significant decisions regarding cannabis legalization. Florida: Smart & Safe Florida Initiative

Florida voters will decide on Amendment 3, which aims to legalize recreational cannabis for adults aged 21 and over. If passed, individuals could possess up to three ounces of cannabis and five grams of concentrate, although home cultivation would not be allowed. This initiative, backed by Smart & Safe Florida, has garnered significant financial support, raising over $80 million. Recent polls suggest that support for this measure exceeds the required 60% supermajority needed for approval, indicating a strong chance of passage in November 2024.

South Dakota: Measure 29

South Dakota voters will revisit the issue of cannabis legalization through Measure 29, which seeks to legalize recreational use and allow individuals to grow up to 12 plants per household. Previous legalization attempts in 2020 were initially approved but later overturned by the courts, while a 2022 initiative was rejected. This is the third time South Dakota voters will weigh in on the issue, with polls indicating a tight contest—45% in favor and 42% opposed.


North Dakota: Measure 5

North Dakota will vote on Measure 5, which would legalize the possession of up to one ounce of cannabis flower, four grams of concentrate, and 300 milligrams of edibles for adults aged 21 and over. Additionally, the measure proposes a regulated cannabis market with a limited number of licenses for retail and cultivation. The state has rejected previous legalization attempts in both 2018 and 2022, but advocates are hopeful that public opinion has shifted in favor of legalization.


Nebraska: Medical Cannabis Initiatives

In Nebraska, two initiatives aim to legalize medical cannabis. The Nebraska Medical Cannabis Patient Protection Act would provide legal protections for patients and healthcare providers, while the Medical Cannabis Regulation Act would create a regulated market overseen by the Nebraska Medical Cannabis Commission. A recent poll shows 70% of voters support legalization for medical use, making Nebraska one of the more promising states for medical cannabis reform.


Arkansas: Medical Marijuana Expansion

In Arkansas, Arkansans for Patient Access has secured a place on the ballot for an initiative to amend the current medical marijuana law. The measure would permit home cultivation, extend medical marijuana card validity from one year to three, and expand eligibility to include recommendations by physician assistants, nurse practitioners, and pharmacists. The initiative also aims to legalize recreational use, contingent upon federal rescheduling of cannabis.


Hawaii, Georgia, Indiana, New Hampshire, Pennsylvania, Idaho

Since July, legislative attempts in states like Hawaii, Georgia, Indiana, New Hampshire, and Pennsylvania have mostly stalled, with many proposals failing to advance in their respective state legislatures. Notably, Hawaii‘s Senate bill aimed at legalizing adult-use cannabis passed the Senate but failed in the House Finance Committee. New Hampshire narrowly failed to pass a compromise bill to legalize and regulate adult-use cannabis in June 2024.
